LEAVE RULES

       (Framed under clause 17(A) (5) of the constitution and byelaws

                      of the Institute)

I. GENERAL

  1. These Rules are applicable to all the regular staff of the Institute.

  1. The Institute works throughout the year except on Saturdays and

Sundays and other closed holidays declared by the Institute.  There is no vacation period for the Institute as is normally the case for Educational Institutions.

  1. Leave should always be applied for and sanctioned before it is availed, except in case of emergency and for satisfactory reasons.

1.4 Leave cannot be claimed as a  matter of right.  When the exigencies

         of the Institute so require, discretion to refuse or revoke leave of any

kind is reserved with the authority empowered to grant of leave.

1.5 No leave, of any kind, can be granted for a continuous period of five

years except with the sanction of the Executive Council

  1. Any claim to leave at the credit of a staff member, who is dismissed  

or  removed from the services of the Institute, ceases from the date of

such dismissal or removal.

2. Authority empowered to grant Leave :

Applications for leave shall be addressed to the Chairman of the Board of Governors of the Institute by the Director and to the Director by other members of the staff.  Leave including Special Casual Leave may be sanctioned by the Director or by a member of the staff to whom the power has been delegated by the Director.  The Chairman of the Executive Council may sanction leave to the Director, but the Director can avail himself of casual leave on his own authority.

3. Commutation of one kind of leave into another kind

  1. At the request of a member of the staff, the authority which grants leave may commute it retrospectively, into leave of a different kind

which was due and admissible to a member at the time leave was

sanctioned, but he cannot claim such commutation as a matter of right.

  1. If one kind of leave is commuted into another, the amount of leave

salary and allowances admissible shall be recalculated and arrears of

leave salary and allowances paid, or amounts overdrawn recovered, as

the case may be.

4.  Rejoining of duty on return from leave on medical grounds

A member of  the staff who has been granted leave on medical grounds shall be required to produce a medical certificate of fitness before resuming duty.

5.  Rejoining of duty before the expiry of leave

Except with the permission of the authority which granted leave, no member of the staff on leave may return to duty before the expiry of the period of leave granted to him.

6.  Casual Leave

Casual leave admissible to the staff members shall be 8 days in a calendar year subject to the condition that not more than 5 days may be allowed at any one time.  The Director or any member of the staff to whom the power has been delegated by the Director may waive this condition in exceptional circumstances.  Sundays and Institute holidays which are prefixed or suffixed or intervene in a period of casual leave will not be treated as part of casual leave.

Members joining during the middle of a year may avail casual leave proportionately or the full period at the discretion of the competent authority.

Casual leave cannot be combined with leave of any other description.

7.  Special Casual Leave

1.  Special casual leave may be granted to members of the staff by the

     Director, or by a member of the staff to whom the power has been

     Delegated by the Director, for the following reasons :

(i)   Male staff members undergoing sterilization operation

                (Vasectomy) under the “Family Planning Scheme” may be given

                Special casual leave for period not exceeding six working days,

           which can be combined with ordinary casual leave.

(ii)   Female staff members undergoing Tubectomy or Salpingectomy

            operation under “Family Planning Scheme” may be given special              

            casual leave for not exceeding 14 days.

(iii)  Inability to come to work due to civil disturbances, curfew or

                 strikes can be combined with ordinary casual leave.

  1. All the instructions issued by Government of India Department of personnel and Training from time to time, in regard to grant of special casual leave shall be followed by the Institute as general guidelines.

8.  Earned Leave

The leave account of every employee shall be credited with earned leave, in advance, in two instalments of 15 days each on the first day of January and July of every calendar year.  The maximum earned leave that can be at the credit of an employee would not exceed 300 days.  In the case of newly appointed employee, earned leave shall be credited at the rate of 2 ½ days for each completed calendar month which he is likely to render in a half year of the calendar year in which he is appointed.  In case of an employee who is due to retire or who resigns from the service, the credit of earned leave at the rate of  2 ½ days per completed calendar month upto the date of retirement or resignation would be given to him.  In case of dismissal, removal or death of an employee, credit of earned leave would be given at the rate of 2 ½ days per completed calendar month upto the end of the calendar month preceding calendar month in which he is dismissed, removed or in which he dies.  If any employee has availed of extraordinary leave or some period of his absence has been treated as unauthorized, the credit to be afforded to his leave account at the commencement of the next half year shall be reduced by 1/10th of the period of such leave and / or unauthorized absence.  While affording credit of leave, fractions of a day shall be rounded off to the nearest day.

9.   Half Pay Leave

(a) The half pay leave account of each staff member shall be credited

 with half pay leave in advance, in two instalments of 10 days each

          on the first day of January and July of every calendar year.

(b) The leave shall be credited to the said leave account at the rate of

5/3 days for each completed calendar month of service which he is

         likely to render in the half year of the calendar year in which he is

         appointed.

© The credit for the half year in which a staff member is due to retire

or resigns from service shall be allowed at the rate of  5/3 days per

completed calendar month upto the date of retirement or resignation.

(d)      When a staff member is removed or dismissed from service or dies  

 while in service, credit of half pay leave shall be allowed at the rate

          of 5/3 days per completed calendar month preceding the calendar

          month in which he is removed or dismissed from service or dies while

          in service.

10.  Commuted Leave

10.1 Commuted Leave not exceeding half the amount of half pay leave due may be granted on Medical Certificate to a member subject to the following conditions :

  1. the authority competent to grant leave is satisfied that there is a

reasonable prospect of the member returning to duty on its expiry ;

  1. when commuted leave is granted, twice the amount of such

leave shall be debited against the Half pay leave due ;

10.2 Half Pay Leave upto a maximum of 180 days may be allowed to be commuted during the entire service, without the production of Medical Certificate, where such leave is utilised for an approved course of study certified to be in the interest of the Institute by the leave sanctioning authority.

  1. Commuted Leave upto 60 days without the production of Medical

Certificate may be granted to a female member on adoption of a child.

  1. Where a member who is granted commuted leave quits service

voluntarily without returning to duty, the commuted leave granted shall be treated as Half Pay Leave and excess leave salary recovered. If the retirement is on health grounds incapacitating him for further service, or in the event of death, recovery shall not be made.

11.  Leave not due

  1. Leave not due may be granted to a member of staff for a period not exceeding 360 days during his entire service, subject to the following conditions;

  1. When the member has no Half Pay Leave at his credit ;
  2. It should be granted only on production of Medical Certificate if the leave sanctioning authority is satisfied that there is a

reasonable prospect of  the member returning to duty after the expiry.

  1. the amount of leave should be limited to the half pay leave the

member is likely to earn subsequently ;

  1. it is not to be granted as Leave preparatory to retirement.

  1. Leave not due may be granted to female member without the

Production of Medical Certificate if such leave is in continuation of

Maternity Leave.

  1. Where a member of the staff, who has been granted Leave not due  

resigns from service or seeks Voluntary retirement without returning to duty, Leave not due sanctioned shall be cancelled and the salary for the period of leave not due which has been granted already, shall be recovered from the member, provided that if the retirement is by reason of ill health incapacitating the member for further service, or in the event of his death, no such recovery be made.

12. Extraordinary Leave

  1. Extraordinary Leave (without salary) may be granted to a member

When ---

  1. no other leave is admissible
  2. other leave is admissible but the member applies in writing

 for Extraordinary Leave

  1. “In the case of Academic Staff members who are on contract                                                      

          employment, Extra ordinary Leave (without salary) beyond 90                  

          days may be considered under special circumstances by the     

          Director with the approval of the Chairman, Executive Council,

          if such leave is for Academic Purposes”   *

  1. No leave of any kind can be granted to a member for a continuous

period exceeding 5 years.  Subject to this limitation , any amount of Extraordinary Leave may be granted to a member.

13.  Maternity Leave

  1. A female member with less than two surviving children may be

Granted Maternity Leave for a period of 135 days from the date of commencement.

  1. Maternity Leave may also be granted for a period not exceeding 45

days to a female member (irrespective of the number of surviving children) during the entire service of that female member incase of miscarriage, including abortion, on production of Medical Certificate.

  1. Maternity Leave can be granted in combination with any leave other

than casual leave.

14.   Paternity Leave

  1. A male staff member with less than 2 surviving children may be

Granted paternity leave for a period of 15 days during the confinement of his wife for child birth i.e. upto 15 days before or up to six months from the date of delivery of the child.

  1. Paternity Leave may be combined with any other kind of leave.

15.  Leave to Female Staff Member on adoption of a child

A female staff member on adoption of a child, may be granted leave of the kind due and admissible (including Leave Not Due and commuted leave not exceeding 60 days without production of Medical Certificate) for a period upto one year or till such time the child is one year old, whichever is earlier.

16. Study Leave

  1. Staff members with not less than 5 years service (one year in the case  

of Academic Staff) in the Institute may be granted Study Leave for undergoing a special course consisting of higher studies or specialised training in a professional or technical subject having a direct and close connection with the sphere of his/her duties or being capable of widening his/her mind in a manner likely to improve his ability as a member of the Institute.

  1. The amount of Study Leave that may be granted to members of staff

shall be 12 months at any one time, and during his/her entire service, 24 months in all, on full Pay & allowances.

16.3  Those applying for study leave shall furnish an undertaking to serve  

         the Institute for a period of 3 years after the expiry of leave.

17.   Miscellaneous

All the provisions/instructions contained in CCS Leave Rules 1972, which are not contrary to any of these rules, and which cover matters not specifically covered by these rules, shall be applicable.

18.  Interpretation of Rules

In case of any doubts or clarifications arising out of the proper interpretation of these rules, the decision of the Executive Council shall be final in all cases.

II.  OTHERS

1.  Government Assignments

Members of the Institute may sometimes be assigned work by the Government.  The period of absence of a member from the Institute for such a purpose will be treated as on duty.

2.   Examinership

Members of the Academic staff may, if invited to do so and with the prior approval of the Director or a member of the staff authorised by him, accept examiner-ship for Post Graduate Degrees.

3.   Short term assignments

Participation by the members of the Academic Staff in Scientific/Academic meetings such as Seminars, Symposia, Workshops, Summer Schools and short term visits to other institutions both inside and outside the country may be permitted by the Director.

4.   Long term assignments

Substituted by Sabbatical Leave, guidelines of which are notified separately.

5.   Period of Deputation

The Institute does not normally encourage the appointment of  staff on deputation / lien from other institutions.  In case if a member of the staff is appointed to the Institute and if he happens to be on deputation from another institutions, the period of deputation will be normally for a period of two years.   Extensions beyond two year period if required will be considered on the merit of the case and may be accepted for further period of maximum one year.  After which he should either revert to the parent institution or should resign there-from and be a permanent staff of the Institute.

ANNEXURE

Guidelines for the grant of sabbatical leave to the academic staff of IMSc. as approved in the Executive Council meeting held on 25.11.03.

Sabbatical Leave (On full salary)

  1.  On the average, a member of the faculty may be granted long leave of     absence (of any kind) to work at a suitable place in India or abroad, for no     more than one year in six years.  The counting for this purpose starts from     the date this member becomes Reader F.

  1. While going on long leave, a member will avail of if only one year at a      time.  Extension for the second year, will be considered only for      exceptional reasons by the Director.  In this case, only the first year can      be taken on sabbatical terms,  the second year being extraordinary leave      and / or part Earned Leave.  However in such a case the total period of      stay abroad will be counted for obtaining the average, under condition 1      (i.e. maximum 2 years at a time in 12 years).

  1. In no case a member can go on long term leave ( for more than 3 months        in an academic year) unless his stay in the Institute between two such     leave is at least 3 years and unless condition 1 & 2 are satisfied.

  1. Short term visits abroad ( for less than 3 months in a given academic year)     on official deputation, earned leave, vacation or extra-ordinary leave with   out pay, etc. will not count for satisfying the conditions 1,2 and 3.  Part     sabbaticals may be granted for periods not less than 3 months at a time,     which will be counted for satisfying above conditions.
